Shenzhen Yanxi Technology Co., Ltd. ("Yanxi") hereby reminds users to carefully read and fully understand this Software License and Service Agreement (the "Agreement"). Please read all clauses carefully, especially clauses related to limitation or exclusion of liability, dispute resolution, and governing law. Clauses on limitation or exclusion of liability are highlighted in bold for your special attention.
Please review this Agreement carefully and decide whether to accept it (minors should read with their legal guardians). By downloading, installing, using this software, or obtaining/logging into an account, you are deemed to have accepted and agreed to be bound by this Agreement.
Yanxi may revise this Agreement. Updated terms will be published on the official website or in the software and become effective from the date of publication. If you do not accept the revised terms, please stop using Yanxi software and services immediately. Continued use constitutes acceptance of the revised Agreement.
1.1.1.1 This Agreement is entered into between you (the "User") and Yanxi and its operating partners regarding your download, installation, and use of the "Yanxi" software and related services.
2.1.2 The software and services are installed on mobile smart terminals and provide official drivers and related Yanxi services.
3.1.3 Ownership and operation rights of this software and services belong to Yanxi.
1.2.1 Yanxi grants the User a personal, non-transferable, non-sublicensable, non-exclusive license to use this software.
2.2.2 The User may install, use, display, and run the software on a single mobile terminal for non-commercial purposes only. Commercial use, unauthorized modification, reverse access via plugins/hacks/third-party tools, or derivative creation is prohibited unless expressly authorized in writing by Yanxi.
3.2.3 Without Yanxi's permission, the User shall not install this software on unapproved terminal devices (including but not limited to set-top boxes, consoles, TVs, DVD devices).
4.2.4 The User may make one backup copy solely for backup purposes, and the backup must retain all copyright notices.
5.2.5 Except as expressly authorized herein, no other rights are granted without Yanxi's prior written consent.
1.3.1 Users shall download/install the software from designated channels only. Yanxi is not responsible for losses caused by software obtained from unauthorized third parties.
2.3.2 Users must select a version compatible with their device model. Any issue caused by incompatibility shall be borne by the User.
3.3.3 Yanxi may provide replacements, modifications, and upgrades (with or without fees, subject to prior consent where required). Older versions may no longer be supported after new versions are released.
1.4.1.1 Removing copyright notices or bypassing technical protections of intellectual property;
2.4.1.2 Reverse engineering, decompiling, disassembling, or attempting to obtain source code;
3.4.1.3 Modifying/falsifying instructions or data to alter software functions/effects, or distributing methods/tools for such purposes;
4.4.1.4 Any behavior endangering network security;
5.4.1.5 Accessing services through unauthorized third-party compatible systems/software or distributing such tools;
6.4.1.6 Unauthorized use, lease, lending, copying, modification, linking, reposting, compiling, publishing, or creating derivatives;
7.4.1.7 Publishing/transmitting unlawful, harmful, or offensive content;
8.4.1.8 Infringing others' IP rights, trade secrets, or lawful rights;
9.4.1.9 Sending spam/advertising in bulk through the software;
10.4.1.10 Any unlawful purpose or any use inconsistent with this Agreement.
1.4.2.1 You may publish content you own or are legally authorized to publish, and your content must not infringe third-party rights.
2.4.2.2 You shall comply with applicable laws, regulations, public order, morality, and authenticity requirements.
3.4.2.3 You shall not publish illegal content, infringing content, false/misleading content, or spam.
4.4.2.4 Without Yanxi's permission, no in-app commercial activities (such as advertising or sales) are allowed.
1.4.3.1 Yanxi may determine whether your behavior violates these rules and may suspend/terminate your license or apply restrictions.
2.4.3.2 Yanxi may directly delete information suspected of illegality/infringement/violation.
3.4.3.3 You are solely liable for damages to third parties caused by your violations and shall indemnify Yanxi.
4.4.3.4 If Yanxi suffers losses, third-party claims, or penalties due to your breach, you shall compensate all losses and reasonable costs.
1.5.1 To provide functions and improve user experience, Yanxi may collect device information, account-related information, and network usage information.
2.5.2 Data collection, use, and protection follow standards aligned with Xiaomi privacy policy requirements as described by Yanxi.
3.5.3 We may share data related to Xiaomi/Mijia products and services with Xiaomi to improve products and user experience.
1.6.1 Device and Charges: You must provide compatible devices/network and bear all communication/network/third-party costs.
2.6.2 Third-Party and Force Majeure: Yanxi is not liable for losses caused by third-party reasons or force majeure.
3.6.3 Security Risk Notice: Internet services involve risks; users should properly secure accounts/devices and use protective measures.
4.6.4 Third-Party Systems: Third-party platforms/services are independently provided and liable by those parties.
5.6.5 Service Adjustments: Yanxi may modify/suspend/interupt/terminate all or part of services as needed.
6.6.6 No Warranty: Except mandatory legal obligations, no express or implied warranty is provided.
7.6.7 User-Caused Losses: Losses caused by user behavior are borne by the user.
8.6.8 User Interaction Risks: Disputes/losses arising from user-to-user interactions are handled by involved parties.
9.6.9 Other Exemptions: Includes account restrictions for violations, third-party content risks, and regulatory changes.
10.6.10 Effectiveness: This disclaimer is an integral part of the Agreement and has equal legal effect.
1.7.1 Yanxi owns relevant IP rights in and to this software and related content, protected by law.
2.7.2 Without prior written consent of Yanxi, users may not exploit or transfer such rights.
1.8.1 Yanxi may modify this Agreement when necessary; continued use constitutes acceptance.
2.8.2 Yanxi and partners may adjust chargeable services, standards, methods, fees, and terms.
1.9.1 This Agreement is governed by the laws of Mainland China.
2.9.2 Place of signing: Huafeng New Energy Building, Bao'an District, Shenzhen.
3.9.3 Disputes shall first be resolved through negotiation; failing that, either party may sue in the competent court at the place of signing.
1.10.1 Certain services may have separate agreements/rules; please read and accept before use.
2.10.2 Effective date of this Agreement: January 01, 2026.
3.10.3 Section titles are for convenience only and do not affect interpretation.
4.10.4 If any clause is invalid/unenforceable, the remaining clauses remain valid and binding.
